We have noted that you have also uploaded the email below providing your update to the portal. I am very happy for this response to be uploaded also. I will ask our relevant consultants to engage with the LLFA, County Ecologist and LHA and I will engage with the ICB and LEA. We will ensure that you are copied into all emails so as to ensure you are fully abreast of any discussions. We appreciate your confirmation of the direction of travel with regard to the application, although admittedly I am surprised that you have confirmed that the recommendation will be to refuse the application rather than suggesting that is your current consideration of the application – particularly given that by the time of any planning committee, both national and local policy could or indeed will imminently be in a fundamentally different position. With regard to the recommendation, are the Council able at this stage to confirm what the likely recommended Reasons for Refusal will be – again noting that a further response from SC Policy is forthcoming as is additional information as requested by statutory consultees? As I am sure you can appreciate, if the recommendation is to Refuse, in complete anticipation that the southern planning committee will agree with this recommendation and refuse the application, we are keen to work with the Council up until determination to address any technical matters so as to avoid unnecessary Reasons for Refusal. It will be of no surprise to the Council that the applicant will be Appealing any refusal, particularly given the significant change in national policy and what we expect to be a situation where the Council do not have an up-to-date Local Plan and a very significant shortfall in housing land supply. Given the scale of the proposed development and indeed the Sites location within the Green Belt, the local opposition and matters pertaining to housing land supply, we already expect that an Inquiry will need to be scheduled for at least 2 full weeks, if not 3 weeks. So as to avoid unnecessary costs both in terms of financial outlay and resourcing for all parties, it is clearly of benefit for all parties to work together over the coming weeks to address as much through this application as is possible. The applicant and consultant team are very eager to work proactively with the Council to do this and once again extend an invitation to discuss the application with you via a teams or in-person meeting. Noting the direction that we now have confirmation that the Council will be taking with the application, in full expectation that members will not support the application, it is also worth noting that PINS now require a S106 Agreement or UU to be provided by the close of an Appeal. As such, it is prudent, even at this point to ask our respect Solicitors to engage and get the ball rolling. I will provide the details of Boningale Homes’ Solicitor in a sperate email, but it would be helpful if HoTs could be agreed in the meantime. I will ask my team to review the statutory consultee comments and start the process of listing out potential contributions – noting that we remain of the position that the contribution being sought for education is unevidenced at this point. By way of further update, I will be providing a detailed response to the submission made by AVAG early next week. Clearly Boningale Homes have engaged with leading Counsel throughout the process. And as are SC Policy, leading Counsel is awaiting the detailed letter from the LPR Inspectors’ in order to finalise their opinion, notwithstanding the fact that the applicant already has advice relating to VSC in the current national and local planning context.
