Elective home education
Under section 7 of the Education Act 1996, parents have the right to educate children, including those with special educational needs (SEN), at home. Home education must be suitable to the child’s age, ability, aptitude and SEN.
Where parents have chosen to home educate a child with an education health and care plan (EHCP) and we're satisfied that the arrangements made by the parents are suitable, we'll amend the EHCP to name the type of school that would be suitable, and will state that parents have made their own arrangements under section 7 of the Education Act 1996.
We have a duty to review the EHCP annually to ensure that the provision set out in it continues to be appropriate, and that your child’s special educational needs continue to be met. We're not under a duty to make the special educational arrangements set out in the EHCP if we're satisfied that the arrangements made by the parents are suitable. This means that the cost of education provision won't be met by us.
