Dear Councillor Barrow,
Thank you for your correspondence dated the 5 January 2024 concerning the proposed speed limit proposed in Coed-Y-Go. I hope the following information clarifies the required statutory process and present situation. As this project has been funded by Community Infrastructure Levy (CIL), any updates will be available to you as the local member on the Member’s Portal. Using the Member’s Portal, any Member will be able to contact the CIL Project team via email (cilproject@shropshire.gov.uk) who will respond, with any and all correspondence available on the Portal to ensure a consistent and accurate record throughout the project’s life-cycle.
As you may already be aware, in accordance with the Road Traffic Regulation Act 1984, Local Highway Authorities are empowered to change or introduce restrictions along the public highway by virtue of Traffic Regulation Orders (TRO’s). The process to implement a TRO requires the Local Highway Authority to undergo a statutory process where the proposed change must first be advertised to the public as part of an initial ‘Consultation Phase’ that has a duration of 21 days. At the close of this Consultation Period, the Local Highway Authority will then review any expressions of support or objection received via the formal channels regarding the proposal, then decide on whether to proceed to implementation, re-design the proposal or abandon it entirely. In the event that the Council decide to proceed to implementation, the next stage will be to send the design documentation to our contractor, Kier, for inclusion in their programme of works for delivery. It must be impressed that Kier’s programme of work and identified priorities always subject to change, depending on external factors including emergency responses to adverse weather conditions, resourcing difficulties and other reasons.
In response to those concerns raised in your correspondence, at present the proposed 40mph speed limit is out for consultation. The Consultation Period is expected to close on the 26th January 2024. Regrettably, for those reasons detailed in the previous paragraph, whilst this scheme is recognised as a local priority, we cannot provide an expected delivery schedule at this time. However, we will provide you an update on the consultation’s outcome following the review of all responses received through the formal channels, with further communication once Kier provide a programme date.

Dear Councillor Barrow,
We hope this correspondence finds you well.
Further to the CIL project Coed-Y-Go: Speed Limit, we have received notification from the Police that while they concur that the recorded speed limit data is consistent with a 40mph speed limit, they have expressed concern that such a restriction is unlikely to be enforced due to its remote setting. Their position is therefore that any speed limit implemented should be “self-enforcing” and that they in turn will forward any complaints regarding excessive speeding to the council. Unfortunately, the professional engineering opinion does not consider any further form of traffic calming appropriate due to the profile of the road and based on the speeding data, wholly disproportionate to its recorded usage.
Considering the above, the CIL Project team would invite yours and the Parish’s thoughts on whether or not to proceed with the advertised proposal following the end of its Public Consultation phase on Friday 26th January 2024.

I am writing to inform you and the Parish Council that the proposed 40mph speed limit along C1010 Trefonen Lane has successfully passed the Consultation Phase. No objections were received.
Before instructing Shropshire Council’s Contractor, Kier, to programme and deliver this scheme, I should take this opportunity to reiterate that the Police have expressed their position that this limit, while appropriate, is unlikely to be enforced. WSP, acting in its role as a Consultant on behalf of Shropshire Council, does not feel any additional traffic calming measures to enforce compliance would be appropriate. Therefore, before proceeding to instruction, we would ask that you and the Parish Council consider whether you would like us to proceed or not. We will await your response via the Member’s Portal (CILProject@shropshire.gov.uk).
Finally, the CIL Project team recognises that this matter has been a long-standing source of local concern, therefore we appreciate yours and the Parish’s patience throughout this process.

Thank you for contacting the CIL Projects Team on behalf of your constituent.
The CIL Projects team would like to thank the local community for their patience whilst this scheme has been progressed. Unfortunately, excessive speed is an increasingly prevalent issue experienced nationally by all communities, and while there are a range of measures available to mitigate such offences, careful consideration and investigation should identify those solutions that are proportionate to the problem and sympathetic to the residents.
As the local Highway & Traffic Authority, Shropshire Council is empowered by the relevant legislation to investigate and change the character of the public highway, when such changes have been deemed beneficial to road safety, air quality and network management. In order to change the character of the public highway, such as introducing a speed limit, is through a statutory process where such changes are ratified as a legal document (otherwise known as a Traffic Regulation Order). Unfortunately, the process to assess ratify the Traffic Regulation Order can be time consuming, as it involves a number of sub-processes, including investigating the feasibility of the proposed; advertising the proposal for Public Consultation; sealing the actual Order; and then implementing it on site. It should be noted that the CIL Projects team have updated Councillor Barrow of developments throughout this process in respect to her position as the local elected Councillor.
I am delighted to inform you and your constituent that the proposed 40mph speed limit has been progressing – and as of last Friday (26th January 2024), successfully passed the Public Consultation phase. It is still Shropshire Council’s intention to deliver this scheme through our designated contractor, Kier. Regrettably, at this time we are unable to confirm any estimated date for delivery.

Following receipt of local support from Councillor Barrow and the Oswestry Rural Parish, this scheme will now be handed over to the Council’s contractor for programming and delivery. To manage expectations, it should be impressed that whilst we will communicate the urgency of this scheme upon the contractor, this scheme will be scheduled in accordance with other planned works and priorities, including emergency responses. Therefore, we trust you will appreciate that at this time the council cannot provide an estimated date of delivery.
