Licences Interim authority notice

Interim authority notices may be given to temporarily prevent a licence from lapsing if the licence holder dies suddenly, becomes incapacitated, insolvent or ceases to be entitled to work in the UK.

An interim authority notice may only be given by a person with a prescribed interest in the premises or by a person connected to the former licence holder, this includes a representative of the former holder, a person with power of attorney or the former holder’s insolvency practitioner.

An interim authority notice must be given within 28 days of the licence lapsing and makes the person or body giving the notice the licence holder, allowing licensable activities to continue at the premises. The maximum period an interim authority notice can be in place for is three months, following which the licence would need to be transferred to prevent it from lapsing.

Am I eligible to give an interim authority notice?

Yes, if you are a person with a prescribed interest in the premises or personal representative of the former licence holder. If you aren’t sure if you are a person who can give the notice, contact the Licensing Team for advice.
